The chief judge, S.R. Singaravelan, also asked whether the Criminal Amendment ordinance, a pre-constitutional measure relied on by the petitioner's counsel, was still valid. Citing a provision in the ordinance, the judge asked counsel what property would be given as security in case of the release of the attached TANSI property. He also asked whether the court was bound by the Government's no-objection to the release of the property or whether it could come to a different conclusion independently applying its mind. Mr. Singaravelan then posted the matter to Wednesday and asked counsel to clarify these issues by then. (Ms. Sasikalaa moved the court for release of the attached property so as to facilitate its surrender to the TANSI itself. Since the property was not to be re-conveyed to any third party, the release would in no way affect the case, she has contended).
