SC fiat on higher pay for dt. judges

NEW DELHI Nov. 25. The Supreme Court today directed the Centre and all the State Governments to implement the higher pay scales for judges of the subordinate judiciary by April 1, 2003, as recommended by the Shetty Commission and accepted by the Supreme Court.

A three-Judge Bench comprising the Chief Justice G.B. Pattanaik, Justice V.N. Khare and Justice S. Rajendra Babu, rejected the plea of the Centre and the States that such implementation would cost the exchequer Rs. 95 crores a year.

The Bench criticised the Centre for delaying the implementation of the new pay scales as recommended by the Commission appointed by the Government. There was no justification for not implementing the pay scales despite the court's earlier direction to implement them.

The Bench also wanted to know from the Centre and the States how they arrived at the figure of Rs. 95 crores.

The order was passed by the Bench on a petition filed by the All India Judges Association and others seeking better service conditions, facilities and pay scales for judges.
