Appeal against quashing of plea for Quattrocchi extradition

New Delhi Dec. 3. India today filed an appeal with the Malaysian High Court against the rejection of its extradition proceedings against the controversial Italian businessman, Ottavio Quattrocchi, wanted by the CBI in connection with the Rs 64-crore Bofors gun deal kickback case, and it is listed for hearing tomorrow.

The appeal was moved by the Malaysian Attorney-General before the High Court in Kuala Lumpur after a formal request was made by India late last night.

Rejecting India's extradition plea, the Sessions Court on Monday termed the reasons given by New Delhi as ``insufficient, vague and ambiguous''.

Mr. Quattrocchi, who was on bail since his arrest in December 2000, was discharged and his passport returned after the order.

India has in its appeal challenged the Sessions Court order that the evidence provided by the country was not sufficient.

Along with the appeal, New Delhi also sought a stay of the Sessions Court order discharging Quattrocchi from the extradition proceedings.

A CBI spokesman told UNI that the appeal was also filed on the ground that the laid-down procedure had not been followed before passing the order. The Government or the prosecution should have been given a chance to plead their case before the court passed the orders.

Though the order was yet to reach the agency headquarters here, the CBI officials got in touch with the officials of the legal wing and deliberated various available options.
