In a fax message to the Chief Election Commissioner, J.M. Lyngdoh, the PCC vice-president, Hasmukh Patel, pointed out that by Dr. Togadia's own claim his and his family members' names figured in the voting list simultaneously from two constituencies which was an offence under Section 17 of the Representation of the People Act, 1950. Dr. Togadia had ``claimed'' that the names had been ``deleted'' from the voting list in the Sarkhej constituency as he was residing in Memnagar for the last eight years and had voted from the same address in the last two Parliamentary and one Assembly elections. The State election office, however, released a list showing that Dr. Togadia and his family members were still registered as voters from Kubernagar falling in the Naroda Assembly constituency. Mr. Patel alleged that Dr. Togadia apparently had given a false declaration by registering himself as a voter in Sarkhej without getting his and his family members' names deleted from the Naroda constituency. Mr. Patel said Dr. Togadia had ``committed a serious breach of law and action should be taken against him under the Act which provides for imprisonment up to one year''.
