3 brothers get death sentence for murdering five of family

TUTICORIN Jan. 8. The Additional District Sessions judge, N. Retnaraj, here, today awarded death sentence to three brothers for committing murder of five members of a family in the district in 2000.

The judge also sentenced Sankaranarayanan, Santhanapandian and Saravanan to undergo seven years RI each for committing the offence under Section 307 IPC.

The judgment said the three accused were a danger to society as they had committed a cold-blooded murder and were also involved in murder cases previously.

According to the prosecution, the murder took place on August 30, 2000 at Thalaikattupuram under the Ettayapuram police station limits. Saravanan married Maheswari in 1998. There were frequent quarrels between them and the latter's parents, Muthusamy and Kuruvathai, favoured an amicable settlement.

Muthusamy, Kuruvathai, Maheswari's brother, Sundaramurthy, and her paternal uncles, Gurusamy, and Lakshmanan, along with five other members of their village, came to Thalaikattupuram for a compromise with Saravanan. At Sankaranarayanan's house, a wordy duel broke out between Sankaranarayanan and Muthusamy. The three brothers armed with deadly weapons attacked the party in which Muthusamy, Kuruvathai, Maheswari and Sundaramurthy were killed on the spot. Gurusamy and Lakshmanan sustained injuries and the former died in hospital on September 16, 2000.

Cases were registered against the brothers who surrendered before the Mayiladuthurai Judicial Magistrate-I on September 4, 2000.

Their bail applications were rejected thrice by the Madras High Court

The charge sheet was filed on October 10, 2000 and 21 witnesses were examined on the side of the prosecution. The case came for trial in the Additional District Sessions Court, Tuticorin, on December 4, 2002 and the arguments were completed on December 30.
