In his 62-page judgment, delivered on Wednesday, Justice Doabia held that passengers who are killed or injured in shooting or bomb blast are eligible to receive compensation. The court was disposing of two sets of appeals (a total of 28 cases), filed by the National Insurance Company against the judgment of the Motor Accident Claim Tribunal (MACT), Jammu. The court quoted an apex court judgment that had held that an injured person must be given compensation even if he was not actually in the vehicle at the time of the incident. Justice Doabia directed that in cases involving minors, the Registrar Judicial of the High Court must deposit the amount awarded in fixed deposits. The money could be disbursed when they attained the age of 21 years.
