A plea was advanced on behalf of the Punjab Government that considering the serious nature of the allegations, the court should answer the reference, notwithstanding the fact that Mr. Sidhu had resigned after the scam. The three-Judge Bench comprised Justice S. Rajendra Babu, Justice Arun Kumar and Justice G.P. Mathur. During the last hearing, the Bench had asked the Attorney General, Soli Sorabjee, to state whether the reference should be continued after Mr. Sidhu had resigned and filed an undertaking that he would not claim any retirement benefits. Today it was submitted on behalf of the Attorney General that the reference was based on the report given by the Punjab Government and it was up to it to state whether the proceedings should be continued or not.
