HC stays new property tax scheme

Belgaum Feb. 2. The High Court of Karnataka issued an interim order on Thursday staying collection of property tax by the City Municipal Council, Gokak.

This is seen as Constitutional victory where the court's order has come as a shot in the arm for all those opposing the alleged unscientific and irrational Self-assessment Scheme of property tax introduced by the Government.

The possibility of other property owners seeking inspiration from this court order and seeking similar relief in respect of municipal bodies, including municipal corporations, which have so far not implemented the scheme and continue to oppose, such as the Belgaum City Corporation, is not ruled out.

In the present case, five civilians, Ashok Shankar Mavarkar, Babu Rudrappa Kadewadi, Mallappa Erappa Jotawar, Jotiba Phakirappa Subhanji and Shivaji Ramappa Gondhali, from Gokak town filed a writ petition in the High Court seeking directions to the Gokak City Municipal Council and quashing of the property tax scheme as it was unscientific and irrational.
