A Division Bench of the Court comprising Justice Devinder Gupta and Justice B.D. Ahmed asked the Government and the two civic agencies to file replies to the petition by April 7. The petitioner, Ashok Aggarwal, a Delhi High Court lawyer, said that the crematorium had caused environmental pollution and made the life for 2,500 residents of the area a hell. He further said that the crematorium was located in the centre of the colony and shared boundary with four schools and some residences. He further said that according to Section 3 of the Delhi Municipal Corporation Act, 1957, no crematorium could be built in the Capital without permission of the Municipal Commissioner. But in this case even the Commissioner could not grant permission to build one as the existing facility was located on a plot which formed part of land earmarked for people relocated from slum clusters here.
