Justice P. K. Misra, permitting Mr. Subramaniam to attend the meeting to be held on February 27, said: "If stay is not granted at this stage, the writ petition (filed by him) itself may become infructuous. The petitioner is a representative of the population of the concerned ward, and in normal course, expected that he should discharge his duties by attending council meetings. Therefore, the direction of the Deputy Mayor, directing Mr. Subramaniam not to attend the meeting shall remain stayed until further orders." However, the judge also recorded an undertaking given by Mr. Subramaniam stating that he would maintain rules or decorum during the council meeting. "This solemn assurance of counsel for the petitioner is accepted", he observed. Stating that there was a prima facie case in favour of Mr. Subramaniam, the judge also admitted his writ petition for hearing `at an early date'.
Anticipatory bail
granted
In another case, Justice C. Nagappan granted anticipatory bail to the Chepauk divisional secretary of the DMK, S. Suresh Kumar, who has been charged with wrongfully tapping power supply during a party meet held on February 18. The charge against the DMK functionary is that he, along with three other partymen, committed the theft of electricity by fixing hook without prior permission of the Electricity Board, and caused damage worth Rs. 764.
