HC stays arrest of Amar Singh

LUCKNOW APRIL 17. The Allahabad High Court today stayed till May 16 the arrest of the Samajwadi Party general-secretary, Amar Singh, in a criminal case registered against the Samajwadi Party leaders in Lucknow, for alleged recording of the proceedings of a Bahujan Party meeting on compact discs (CDs) and "tampering" with the recordings in a fraudulent manner.

A Bench consisting of Justice Vishnu Sahai and Justice Abdul Matin, sitting in Lucknow, granted the stay on a petition filed by the SP leader, which sought quashing of the FIRs on the ground that the case was politically motivated.

While fixing May 16 as the next date for hearing of the petition, the Court directed the State Government, the Principal Secretary (Home), the Chief Minister and the U.P. BSP president, K. K. Sachan, to submit their reply before it by that date.

The FIRs were filed by Mr. Sachan on April 14 against the SP president, Mulayam Singh Yadav, besides Amar Singh and seven party leaders at the Hazratganj police station here. Mr. Sachan alleged that the party leaders had got the recordings done stealthily. Also the CDs had been selectively edited before the SP leaders had publicised the contents.

The State SP general-secretary, Shivpal Singh Yadav, Balram Singh Yadav, leader of Opposition in the Assembly, Azam Khan, Deputy leader, Ambika Chaudhary and legislators, Om Prakash Singh and Chandra Bhadra Singh, are the other accused named in the FIRs.

Mr. Amar Singh filed a petition challenging the FIR on Wednesday, seeking quashing of the FIRs and stay on the arrest of the SP leaders on the ground that the action was the result of political vendetta unleashed by the Chief Minister. The petition apprehended that the plaintiffs might be arrested and sent to jail any time under pressure from the Ms. Mayawati.
