SRB challenges order against disqualification

CHENNAI APRIL 25. The Leader of the Congress legislature party, S.R. Balasubramaniam, has petitioned the Madras High Court to quash an order of the Speaker, turning down his plea to disqualify four MLAs, three of whom belonged to the erstwhile Tamil Maanila Congress.

According to Mr. Balasubramaniam, D. Kumaradas (Killiyur), M.A. Hakkeem (Madurai Central), R. Eswaran (Vasudevanallur) and C.K. Tamilarasan (Nannilam) would attract disqualification under the provisions of the 10th Schedule Para 2(1)(a) of the Constitution. While the first three legislators floated the Tamil Maanila Kamaraj Congress during TMC-Congress merger, and later merged with the AIADMK, Mr. Tamilarasan remains an unattached member.

On January 30, 2003, Mr. Balasubramaniam, in his capacity as CLP leader, submitted a representation to the Speaker seeking to declare the four MLAs disqualified as per the stated provisions.

Through an order on March 19, the Speaker, however, rejected the representation. The rejection order was communicated to the petitioner by the Secretary of the Legislative Assembly.

The petitioner impleaded, besides the four MLAs and the Speaker, the Secretary as one of the respondents.

As an interim relief, the Congress leader sought an injunction restraining the MLAs from attending and participating in the Assembly proceedings, and signing attendance register till the disposal of the case.

The petition is expected to come up for admission on Monday.
