A three-Judge Bench, comprising the Chief Justice V.N. Khare, Justice S.B. Sinha and Justice A.R. Lakshmanan, did not stay the proceedings pending before the High Court. However, the Chief Justice told senior counsel, Anil B. Divan, that ``if the trial goes on, you (can) approach this court and we will consider your request for stay then''.
