The Bill envisages restructuring of the existing university bodies and formation of the State Council for Higher Education for coordinating the functions of the universities in the State. The Syndicates and senates in the universities would be replaced with nominated executive councils and predominantly nominated general councils. The Bill has a separate chapter empowering the Government to regulate private unaided colleges. The Government will have powers to regulate admission, qualification of teachers and conditions of service of teachers including salaries. It bans levy of capitation fee. The Government will establish a system for determining the fees to be collected by the institutions. The universities, on the other hand, will have the freedom to determine their fee structure. The Bill also has provisions for establishment of autonomous colleges. Private tuition by teachers will be banned. Teachers of private colleges elected to local self-governments would have to go on leave. The Cabinet has decided that the Bill would be introduced in the coming session of the Assembly. With enactment of the Bill and notification of the rules, the existing university authorities will cease to exist and the Vice-Chancellors will go out of office. The Bill proposes appointment of new Vice-Chancellors by the Chancellor (Governor) on the basis of recommendations of a four-member panel consisting of a nominee each of the Chancellor, the University Grants Commission, the Government and the Executive Council. The powers of the Chancellor in regard to the appointment remain unchanged. The Executive Council will consist of six ex-officio members the Vice-Chancellor, Pro Vice-Chancellor, Secretary (Higher Education) or his representative and the Directors of Collegiate, Technical and Medical education, and nine nominated members. The nominations would be made from among academics such as deans of university departments, principals of colleges and teachers. The General Council will have about 100 members with 27 elected members. Of the elected members, five will be elected from among members of the Assembly, two from among principals of professional colleges, five from among principals of non-professional colleges, ten from among teachers of affiliated colleges, one from among teachers of university departments, two from among non-teaching staff of the university and two from among the non-teaching staff of affiliated colleges. Nominated members will include people from various walks of life including trade unions. The council is to function as a social audit and consultative body. It will have powers to review the university budget and advice the Executive Council. The State Council, which will be chaired by the Education Minister, who is also the Pro Chancellor of the university, will fix norms and standards for functioning of the universities. It will have Vice-Chancellors of all the universities as members and will be a forum to iron out differences between universities regarding admission norms and the like. However, it would not interfere with academic freedoms of the universities while fixing administrative norms. The university will need clearance of the Government for creation of new posts and for taking up new projects requiring financial commitment from the part of the Government.
