Police seek custodial interrogation of Azhagiri

MADURAI, MAY 29. The investigating officer in the Kiruttinan murder case today filed a petition in a Madurai court, seeking a five-day custodial interrogation of M.K. Azhagiri, son of the former Chief Minister, M. Karunanidhi.

During preliminary investigation, a special team attached to the city police claimed to have secured "clinching" evidence leading to a breakthrough in the case of murder of the former DMK Minister was murdered near his K.K. Nagar residence early on May 20.

Six persons, including Mr. Azhagiri and the former Aavin (Madurai and Theni districts) Chairman, P. M. Mannan, were arrested for "conspiring" and "executing" the killing. Vehicles and weapons used for the commission of the offence, besides some documentary evidence substantiating the conspiracy theory, were also seized, the police said.

Today, in a petition filed before the sixth judicial magistrate, K. Vanitha, the Sellur inspector, S. Murugesan, said interrogation of the four DMK functionaries and other witnesses had "made it clear" that Mr. Azhagiri was involved in the "conspiracy" to murder Kiruttinan. "A five-day custodial interrogation of the accused, under the provisions of Section 167 (2) Cr.P.C., is essential to unearth some facts (that led to the murder), which are known to the accused alone," he said.

Mr. Murugesan assured the court that Mr. Azhagiri would not be subjected to any mental or physical harassment and his basic needs would be taken care of. With the extension of remand for Mr. Azhagiri, lodged in the Tiruchi central prison, slated for June 4, the magistrate posted further hearing on the petition for Monday.

Meanwhile, in a petition submitted in the court, counsel for Mr. Azhagiri, has pleaded against police custody for his client. "The accused has instructed counsel that he has no knowledge or information (about the murder) and does not want to be handed over to the police," the DMK advocates, Premraj Ambrose and S. Mohan Kumar, said adding the petitioner might be given an opportunity to submit his objections.

Nine DMK cadres held

In another development, the Subraminapuram police today arrested nine Azhagiri loyalists on charges of "conspiring" to cause loss to public property and obstruct routine functioning of government offices.

The Madurai Corporation councillor, V.K. Gurusamy; the former councillor, V. Manickam; R.S.T. Pandian, M.L. Raju, S. Jayaram, M. Udayakumar, S. Nagesh, M. Rajendran and V. Saravanan were held under Section 151 Cr. P. C. and 7(1) (a) of the Criminal Law (Amendnent) Act for "gathering" at Kovalan Nagar here early today and "planning" to disrupt Tamil Nadu State Transport Corporation bus services to protest the arrest of Mr. Azhagiri and four others.

The fourth judicial magistrate, Balasubramaniam, remanded the accused to judicial custody till June 6, according to police sources.
