A vacation Bench comprising Justice R.C. Lahoti and Justice Brijesh Kumar posted the application for hearing on June 16 after counsel for the petitioner, R. Shanmugasundaram, `mentioned' for early listing of the case. On June 5, the earlier Bench while adjourning the proceedings gave liberty to the petitioner to `mention' this week for early listing of the case. The court had on May 7 issued notice to the State Government on the application and the latter in its response had denied the petitioner's allegations. But, Mr. Gopal in his rejoinder had reiterated the charge that a false case under POTA had been registered against him. In his application, Mr. Gopal submitted that the continued harassment at the hands of the police, the way in which he was being tortured and the way things were being planted, would all show that no proper investigation would be done by the State police. Hence he prayed for a direction to entrust the investigation to the CBI the circumstances under which he was arrested; the alleged recovery of arms and a pamphlet in an alleged bag; the fresh cases filed against him and recoveries alleged to have been made in the forest.
