Medical seats: SC notices to Centre, T.N., Pondy Govts.

NEW DELHI JUNE 26. The Supreme Court today issued notice to the Centre on a petition challenging the guidelines issued by the Government of India, stipulating that private managements could fill only 25 per cent of seats and 75 per cent seats be filled through a common entrance test.

The notice, returnable by July 3, was issued by a vacation Bench comprising Justice R.C.Lahoti and Justice Brijesh Kumar on the petition filed by Thirumuruga Kirupananda Variyar Thavathiru Sundara Swamigal Medical Educational and Charitable Trust, running Vinayaka Mission Medical College in Salem in Tamil Nadu and two in Pondicherry besides paramedical courses.

The Bench also issued notice to the Tamil Nadu and Pondicherry Governments which had issued orders based on the Centre's guidelines.

While Tamil Nadu said that 40 per cent of the seats be filled through the single window system and 60 per cent by the private management, Pondicherry said that 50 seats be filled by the Government and 50 per cent by the management.

The petitioner said substantial questions of law of general public importance with regard to the powers of the Central and State Governments and Union Territory to interfere with the autonomy and admission in unaided minority professional colleges were involved in this petition.

Further, the petitioner said the Tamil Nadu Government had fixed a minimum eligibility criteria for admission in respect of all students which was quite contrary to the eligibility norms fixed by the Medical Council of India.

Contending that the actions of the Central and State Governments were clearly unconstitutional and not in conformity with the apex court's ruling in T.M.A. Pai's case, the petitioner sought quashing of the impugned guidelines and the consequent G.O.s.
