A Bench comprising Justice M.B. Shah and Justice A.R. Lakshmanan gave this direction on Monday when Sanjay Parikh, counsel for the petitioner, CEHAT, Masum and Dr. Sabu M. George brought to the notice of the court about the advertisements on "how to select the sex determination of your baby'' being given by the clinic in its website. He showed to the court a copy of the print out downloaded from the website. The Bench asked Maharashtra to invoke the provisions of the Pre-Conception and Pre-Natal Diagnostic Techniques (Prohibition and Sex Determination) Act banning such sex selection tests and file an action taken report in the court in three weeks. When counsel submitted that except Goa and Gujarat other States had not so far set up State advisory boards, the Bench asked the remaining States which had not filed affidavits in this regard to file their response within three weeks.
