Justice O.P. Dwivedi, in an ex parte hearing, issued notices to the Andhra Pradesh-based Triumphant Institute of Management Education and Time Education Pvt. Ltd for using the mark TIME in their promotional activities which, according to the publisher, amounts to infringement of its registered trade mark. The American publisher, through its counsel, Chander M. Lall, alleged that by using the trade mark in respect of printed periodicals and publications as well as in teaching and instructional material either in print or on web site, the Secunderabad-based entities were guilty of passing off their material as those of the internationally-acclaimed publisher. Time Inc. has sought imposition of curbs on the Indian entities from using TIME or any name deceptively and confusingly similar to it. The publisher alleged that the two organisations were making every effort to promote themselves, both in print and on the Internet as TIME without disclosing their true corporate name. PTI Our Hyderabad Staff Reporter writes: The city-based Triumphant Institute of Management Education has expressed surprise at the TIME magazine's move to sue it for infringing on its brand name. "We have not infringed on any trade mark. Nor do we have any malafide intention to take advantage of the name. Nowhere have we tried to give the impression that we are an associate of the magazine,'' the Institute director, P. Viswanath, said in a statement here on Wednesday.
