Ms. Taylor, who alleged that the serial was a plagiarised version of her novel, "Woman of Substance" had filed a special leave petition in the apex court against the impugned judgment seeking stay of the telecast of the serial.She alleged that her copyright had been infringed by the channel as it was serialising her novel without her consent.A Bench, comprising Justice N. Santosh Hegde and Justice B.P. Singh, before whom the SLP came up for hearing today dismissed it on the ground that the balance of convenience was in favour of telecast of the 280-episode serial. The Bench, however, set aside that portion of the High Court order directing the novelist to pay damages/costs to the channel and said this aspect could be gone into by the trial court at the time of final disposal of the case.A Division Bench of the High Court while allowing telecast of the serial, starring Bollywood star, Karishma Kapoor, also asked Ms. Taylor to pay damages for the delay in the serial's telecast as well as litigation cost.
