A three-Judge Bench, comprising the Chief Justice, V.N. Khare, Justice S.B. Sinha and Justice Arun Kumar, gave the direction on a petition from Rakesh Srivastava `Nyayik' seeking conferment of Bharat Ratna award on leading freedom-fighters, Madan Mohan Malaviya and Sir Syed Ahmed.The Bench requested the Attorney-General, Soli Sorabjee, to find out and inform the court whether the guidelines laid down by the apex court in the `Balaji case' on conferring Bharat Ratna on eminent personalities was being followed by the Government or not. Mr. Sorabjee submitted that the high-power committee on conferment of the award was broad-based to include people from many walks of life and that it was not being run by bureaucrats alone.
