Pepsico India Holdings Private Limited along with its bottler filed a petition within three days of the CSE suggesting that both Pepsi and Coca Cola were selling 12 branded products with much higher pesticide contents than permissible limits. Demanding independent evaluation of the "damaging" report, the writ petition contended that the CSE laboratory had no accreditation and the methods and process adopted in preparing the report was "suspect". Terming the report as "dubious", it said the Government department had acted upon the report without ascertaining its veracity and directed stoppage of Pepsi's products. Requesting the High Court to direct the Government not to act on the basis of the CSE report alleging presence of pesticides in seven of its products much above the permitted levels compared to the same product in the European Union, Pepsi said there had been a barrage of media publicity disparaging its beverages.
