The First Bench comprising the Chief Justice, B. Subhashan Reddy, and Justice A.K. Rajan ordered notices to the Health Secretary and the companies, and posted the matter for August 21. The petitioner, G. Rajendran, contended that consumers were entitled to know the contents, including the percentage of the harmful substances contained therein. Relying of the recent finding by a Delhi-based service forum, and the consequential reports alleging presence of pesticide and other harmful substances in these colas more than the permissible limits, the petitioner wondered how the Health department failed to take any step to analyse the quality of these drinks manufactured and sold in Tamil Nadu. Noting that the State Government was duty-bound to ensure the safety of citizens, the petitioner also sought an interim injunction restraining the soft drink majors from manufacturing, selling and distributing the colas.
