A Division Bench, comprising the Chief Justice C.K. Thakkar and Justice A.S. Oak, declining to stay the CAS, adjourned the matter for final hearing in the third week of January next year. Prominent Gandhian, Usha Mehta, and others had filed the petition challenging the Centre's decision to implement CAS in the metropolis on the ground that it was not in public interest, as the installation of a set top box would benefit only the broadcaster. Advocate, Subba Rao, appearing on behalf of the petitioners, told the court that to view the same number of channels which were now available on cable television, the viewers would have to pay nearly Rs. 800, which would be an additional financial burden, apart from the maintenance of the set top box. Advocate, S.G. Page, arguing on behalf of the Centre, told the court that the Union Government was firm in its decision to implement the CAS in the four metropolises Mumbai, Delhi, Chennai and Kolkata. UNI
