Summons to Elangovan, Varadarajan

CHENNAI NOV. 5. A city court today ordered issue of summons to the State CPI (M) secretary, N. Varadarajan, and the Tamil Nadu Congress Committee working president, E.V.K.S. Elangovan, for their appearance on November 24 and 25 respectively in connection with charge sheets filed against them under the Tamil Nadu Essential Services Maintenance Act.

Copies of the charge sheets will be given to them when they appear before the court of the additional chief metropolitan magistrate, Egmore, D. Arulraj.

The police submitted separate charge sheets against the DMK president, M. Karunanidhi; the CPI State secretary, R. Nallakannu; Mr. Elangovan and Mr.Varadarajan on Friday last for an offence under Section 5 of the special legislation for allegedly instigating government employees and teachers, coming under essential services, to strike work (in July this year) with a view to paralysing the government machinery and the administration.

The relevant TESMA provision states ``Any person who instigates or incites other persons to take part in or otherwise acts in furtherance of a strike, which is illegal under this Act, shall on conviction be punished with imprisonment for a term which may extend to three years or with a fine which may extend to Rs.5,000 or with both''.

The filing of the charge sheets followed the registration of a case by the police in August based on a complaint from the State Public Secretary and conduct of further investigation.

When the charge sheets were presented, the court returned them to the police seeking clarifications.

Enquiries revealed that the police sent back the charge sheets against the Congress and CPI (M) leaders after correcting defects.

Taking the charge sheets on file, the additional CMM ordered issue of summons to Mr. Elangovan and Mr. Varadarajan.

The police are likely to resubmit the charge sheets against Mr. Karunanidhi and Mr. Nallakannu in a couple of days.
