The complaint, filed by Parvesh Khanna under Section 2 of the Prevention of Insults to National Honour, 1971, in the court of the Additional Chief Metropolitan Magistrate (ACMM), would come up for hearing before the Metropolitan Magistrate, Sanjiv Jain, on December 20. The complainant alleged that the respondents had dishonoured the National Flag in full public view by sticking a photograph of the Congress president, Sonia Gandhi, on the emblem of the flag, Ashok Chakra. Mr. Khanna alleged that Ms. Dikshit and her associates had deliberately allowed supporters of the party to carry such flags disregarding the Constitutional obligations and decorum of the National Flag. He further said that the use of the National Flag at the function was uncalled for as it was a political gathering. Besides, the act on the part of the respondents was also in violation of the moral code of conduct of the Election Commission.
