Fee structure case: hearing adjourned

KOCHI, JUNE 8. The Kerala High Court today adjourned to June 22 hearing on a writ petition challenging the order of the K.T. Thomas Committee fixing a fee structure for self-financing medical colleges in the State.

Justice K. Balakrishnan Nair adjourned the case to enable the Advocate General to take instructions on the matter.

The writ petition was filed by Joy P. Jacob, Secretary, Malankara Orthodox Syrian Church Medical Mission. According to the petitioner, the fixation of fee by the committee was per se illegal and arbitrary. The committee had fixed the fee on extraneous considerations.

The figures had been arrived at on the basis of mere assumptions.

It had refused to take into consideration various materials placed by the petitioner before the committee.

In fact, the Supreme Court had directed that the fee should be fixed, keeping in mind the infrastructure, other facilities available, the investment made, salaries paid, and future expansion plan of the institution concerned.

The petition against the committee's directive to the self-financing medical college managements to extend the date of receiving applications for common entrance test and also reschedule the proposed examination from June 13 was adjourned to June 10.

The petition was filed by the Association of Kerala Self-financing Medical, Dental, Ayurveda and Sidha Colleges.

Case against Paloli stayed

Justice G. Sasidharan has stayed the criminal proceedings initiated before the Kottayam Judicial First Class Magistrate III against the LDF convener, Paloli Mohammedkutty, in connection with the incidents that took place at the SBT, Kumarakam, on March 11, 2003, a hartal day.

The case was registered by the Kumarakom police. He had been named first accused in the case. The allegation against him was that he had instigated other accused to trespass into the compound of the SBT Kumarakom branch and threaten the branch manager.

The stay against the proceedings would remain in force for two months.

Plea for Plus Two course

The Malankara Metropolitan, Baselious Mar Thoma Mathews II, has filed a petition seeking a direction to the State Government to grant Plus Two courses to the school under the management of the Catholicose - Adoor St. Mary's High School.

The hearing on the petition was adjourned to June 15. According to the priest, despite the High Court directive, the Government was yet to grant Plus Two courses to the school. The Government had taken a stand that it was a policy decision not to grant Plus Two courses in any schools. However, the Government had recently decided to grant Plus Two courses in as many as 10 high schools.
