Apex court reserves order on Sankaracharya's petition
New Delhi (PTI): The Supreme Court on Thursday reserved its order on the Kanchi Shankaracharya Jayendra Saraswathi's petition opposing the Tamil Nadu Government's move to appoint its own public prosecutor in the sensational Sankararaman murder case, whose trial was shifted to neighbouring Pondicherry.
A bench headed by Chief Justice K G Balakrishnan reserved the order after two days of arguments.
Citing earlier decisions of the apex court in the Gujarat's "Best Bakery" and MP's "professor Sabharawal" cases, senior counsel U U Lalit told the apex court that since the trial in his case has been shifted to Pondicherry, the public prosecutor should also be from there.
He further submitted that the apex court should address an important question as to which State should be vested with the power of appeal against the order of acquittal, if any, by the trial court.
Senior counsel Altaf Ahmed appearing for the Tamil Nadu Government maintained that Section 24 CrPC provides exclusive right to a State for appointing its own public prosecutor and hence the pontiff's plea should not be entertained.
