Court ruling on illegal constructions: a clarification

With reference to the news item `Amended regularisation scheme quashed,' dated August 24, the High Court's directions for demolition relate to commercial multi-storeyed (more than four floors) and commercial special buildings (ground and three floors).

The court has ordered that where the entire construction of such buildings is illegal, the building has to be demolished. Where an extra floor has been put up illegally in such buildings, such floor should be demolished. Necessary modifications/ demolitions must also be done for satisfying norms for fire safety and car parking facilities within the building premises.

In the case of residential multi-storeyed and special buildings, the court has directed that the Monitoring Committee appointed by it may suggest less stringent measures bearing in mind the impact caused to the neighbourhood and the community by such illegal construction.
