Court orders alleged rape victim's medical examination

Report submitted by Gokulpuri police rejected

New Delhi: Rubbishing the plea of police that the victim was neither mentally-challenged nor was raped, a Delhi court on Saturday ordered the medical examination to verify the facts before recording her in-camera deposition.

Finding fault with the report submitted by the Gokulpuri police, Metropolitan Magistrate S K Malhotra directed the former to get the victim medically examined at a Government hospital to verify the allegations made by her father Bheem Sen.

Opposing Mr. Sen's contentions, public prosecutor informed the court that the accused had molested the girl and an FIR was rightly lodged for the same. He further asserted that the victim, contrary to her father's claim, was mentally sound.

Earlier in his application, Mr. Sen had alleged that one Kallu hailing from the same locality had sexually assaulted his mentally-challenged daughter at a knife point on August 27 and threatened to kill her if she disclosed the same to anyone.

He alleged that the police had registered his complaint under milder section 354 (outraging the modesty of woman) of the IPC despite his assertion that his daughter was raped by the accused.

His counsel told the court that instead of conducting the medical examination of the victim as she was raped, police tried to hush up the matter by registering the same under a bailable section which intended lesser punishment. -- PTI
