New Delhi: A Mumbai financier, who claimed that she had given Rs. 9.70-crore in loans to actor Sridevi, on Wednesday moved the Supreme Court challenging a Bombay High Court order staying the proceedings against her in three cheque bounce cases. Madhu Gupta, in her special leave petition, said she filed the cases after the three cheques for about Rs. 9.70 crore Ms. Sridevi gave her bounced. Even as the magistrate issued a process in these cases, filed under Section 138 of the Negotiable Instruments Act, the actor filed an application in the High Court for quashing the proceedings. The actor contended that she had not issued the cheques and her signature was forged. The High Court stayed all further proceedings. In her appeal against this interim order, Mrs. Gupta said the Supreme Court had repeatedly held that the High Courts’ power under Section 482 of the Criminal Procedure Code (to quash lower court proceedings) should be used very sparingly. © Copyright 2000 - 2009 The Hindu |
