Court: need to revisit anti-dowry law

NEW DELHI: The Delhi High Court has once again observed that there is need for a fresh look at the anti-dowry law.

Justice Aruna Suresh made this observation while granting bail to an accused charged under Section 304B (causing death for dowry) of the IPC, saying there was no incriminating evidence against him.

She said: “It seems that the anti-dowry law is being increasingly misused by women, and the ground realities have persuaded this Court to recommend to the authorities to revisit the law.”

Many other judges of the Court had also called for amending the law to prevent its misuse.

In the instant case, the victim’s parents had lodged a case with the Aman Vihar police in Outer Delhi against the accused and his family claiming that they had driven their daughter to death by harassing her for dowry.

However, the accused submitted that he and his parents were innocent as he, along with his wife and son, was staying in Aman Vihar and his parents stayed in Rohini. He said there was no substance in the allegation against him.

He further submitted that the post-mortem report did not specify any reason for his wife’s death. It said the victim had died due to a seizure.

According to the prosecution, the victim had fallen down while watching TV. Her husband had rushed her to a hospital where the doctors declared her brought dead.
