Non-registration of case: Court seeks reply from Delhi Police

NEW DELHI: The Delhi High Court on Wednesday sought replies from the Joint Commissioners of the Crime Branch and the Northern Range of Delhi Police on a petition by a woman accusing the police of not registering a case in connection with the murder of her brother in August last year.

The petitioner, Radha, approached the Court when a Metropolitan Magistrate’s court here failed to issue any direction to the police on her complaint seeking a direction to the investigating agency to register a case.

According to the petition, the petitioner’s brother Brijesh was murdered on August 5 last year.

Radha stated that she had moved the High Court earlier as well when the local police failed to register a case. The High Court had at that time directed her to file a complaint in a lower court, the petition stated.

She had thereafter moved a Metropolitan Magistrate’s court on August 22 last year.

She stated that the lower court had been hearing her complaint for more than a year because the police had not been able to take a stand on it.

She further stated that despite several notices to the city police by the court they had failed to file a reply to the complaint for as long as seven months. Thereafter the Rohini police SHO appeared before it and made an oral submission, the petitioner stated.

Then an Assistant Commissioner of Police, Rohini, appeared in the court and informed it that the case had been transferred to the Crime Branch.

The petitioner alleged in her petition that the court had given undue liberty to the police in the matter.

Pulling up the police and the Magistrate for sitting over the matter unduly, Justice Kailash Gambhir directed the Joint Commissioners to file replies to the alleged dereliction of duty on their part by November 18.
