Terror: order on December 4

Judicial custody extended to December 18

HUBLI: The First Additional District and Sessions Court judge V.G. Bopaiah on Tuesday posted the the discharge applications of alleged SIMI activists Shakil Mali and Allahbaksh Yadwad for orders on December 4.

The judge posted the case for orders after hearing the arguments of the prosecution represented by Public Prosecutor C.S. Patil and counsel for the accused Ismail D. Jalagar.

Mr. Jalagar had filed the application under Section 227 of Cr.Pc urging the court to drop the charges against the accused as there was no substantial evidence to prove their involvement in the case. Mr. Patil, who had filed objections, said that the accused were involved in the case as much as the other accused persons in the case, and requested the court not to drop the charges.

The Corps of Detectives on Tuesday produced 11 of the 16 accused in the case before the court following the directions of the court which had asked them to produce all the accused in the case without fail.

The police submitted to the court that as the remaining five accused Raziyauddin Nasir alias Riyazuddin Nasir, Hafiz Hussein Mulla (Adnan), Shibli, Safdar Nagori and Qamaruddin were being produced before courts in Ahmedabad in connection with various cases, they could not be produced before it.

Mr. Bopaiah extended judicial custody of the 11 accused till December 18 and issued directions to the Indore Jail authorities to produce the remaining five accused before the court without fail on the next date of hearing.

Permitted

The judge allowed one of the accused in the case, Mirza Ahmed Baig, a house surgeon of KIMS, Hubli, to speak to his father Mirza Quaza Baig in the court hall after Mr. Baig sought permission.

Mr. Quaza Baig, who was waiting outside the court hall, was sent for and the judge allowed Dr. Baig to speak to his father in the court hall for a few minutes. As Dr. Baig’s father was leaving after speaking to his son, the judge asked the accused, “Suffice?”, to which he nodded in approval.
