Plea dismissed

CHENNAI: The Madras High Court on Wednesday dismissed a petition by a panchayat president in Cuddalore district seeking a direction to the Election Commission to hold a by-election in the Mangalore Assembly constituency along with the by-poll in Tirumangalam constituency on January 9. In his petition, G. Ramalingam, president of the Ivanur panchayat, said with Mr. K. Selvam submitting his resignation as an MLA to the Assembly Speaker, the seat had fallen vacant. So, the people of the constituency did not have a representative in the Assembly.

When the matter came up before a Division Bench comprising Acting Chief Justice S.J. Mukhopadhaya and Justice V.Dhanapalan, the Government Pleader submitted that Mr. Selvam had submitted his resignation on a plain paper and not in the format. Hence, the Speaker had not taken a decision on the same yet.
