Proceedings stayed against Satyam Babu

HYDERABAD: Justice P. Swarup Reddy of the A.P. High Court on Wednesday stayed further proceedings against Satyam Babu in the case of murder of Ayesha in a hostel near Vijayawada one year ago.

The judge passed these orders as the proceedings against him were going ahead in the concerned magistrate court without supplying all the documents to him as the law mandates.

Section 207 of the criminal procedure code stipulates supply of documents to the accused.

Petition filed

Satyam Babu filed a petition before the magistrate court at Vijayawada contending that all the documents were not given to him.

The magistrate has to send the case to the session’s court (referred to as committal proceedings in legal parlance).

At this stage Satyam Babu contended that the investigation was not yet over and final report had not yet been filed and all the documents were not given to him.

The police said that the documents would be given at the time of trial in the sessions court. The court at Vijayawada dismissed his petition.

Revision petition

A revision petition was filed in the High Court. The accused contended that the reports of alleged DNA profile of deceased Ayesha, footprints, hand written letter available at the scene of offence, narco analysis test allegedly conducted upon Koneru Satish and inmates of the hostel were not supplied to him.

He said that the prosecution heavily relied upon medical evidence in this case and he, as an accused must be given all these documents at the committal stage it self.

As the police had admitted that the all these were not yet given to him Justice Swaroop Reddy stayed further proceedings.
